1.1 License, Not Sale: KeyFlow Pro is licensed, not sold, to You. Subject to valid payment and compliance with this EULA, Spark Digital Marketing grants You a limited, non-exclusive, non-transferable, revocable license to install and execute KeyFlow Pro on the specific number of personal computers ("Permitted Devices") authorized by your license tier.
1.2 Intellectual Property: All title, trade secrets, copyrights, and intellectual property rights in and to KeyFlow Pro remain the sole property of Spark Digital Marketing. All rights not expressly granted are reserved.
1.3 Restrictions: You shall not: (a) decompile, disassemble, or reverse-engineer the software; (b) modify, crack, or bypass cryptographic licensing mechanisms; (c) share, publish, rent, lease, or resell your License Key; or (d) spoof, intercept, or tamper with communications to keyflow.sparkdigitalmarketing.in.
2.1 Local Execution: KeyFlow Pro processes hotkey events, text-expansion content, macro configurations, and screen OCR captures locally on your device. We do not scan, collect, log, or upload your keystroke content, documents, or personal clipboard data to our servers for licensing or updates.
2.2 Automated Licensing & Security Handshakes: KeyFlow Pro communicates via HTTPS with servers operated by Spark Digital Marketing solely for essential operational functions: (a) verifying License Key validity and seat counts via a pseudonymous cryptographic hardware hash (SHA-256 HWID); and (b) checking for and downloading signed security and feature update packages.
2.3 Offline Grace Period: An active internet connection is required for initial activation and periodically to maintain license verification. If KeyFlow Pro cannot reach the licensing server for an extended grace period (exceeding 14 consecutive days), Pro features may temporarily pause until connectivity is restored.
3.1 Breach: Unauthorized key sharing, seat enumeration abuse, reverse engineering, or chargeback fraud will result in immediate revocation and blacklisting of the License Key without refund.
3.2 Unbinding: You may unlink your device identifier from our server using the in-app "Deactivate This PC" feature to transfer your license to a new workstation.
4.1 Disclaimer: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KEYFLOW PRO IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.
4.2 Liability Cap: IN NO EVENT SHALL SPARK DIGITAL MARKETING BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NEVER EXCEED THE EXACT LICENSE FEE ACTUALLY PAID BY YOU FOR KEYFLOW PRO IN THE PRECEDING TWELVE (12) MONTHS.
This Agreement is governed by the laws of the Republic of India. Nothing in these terms limits statutory rights that cannot lawfully be excluded under mandatory consumer laws in the customer's jurisdiction.
